Lawyer Gurgen Nersisyan Urges Attention to Mechanism of Protection of Rights in Judicial Information System

The use of the mechanism of protection of the right to demand information in the judicial system was reaffirmed during a press conference held by lawyer Gurgen Nersisyan at the LSA Law Chamber. According to Nersisyan, the judicial information system requires minimal data entry in accordance with the Civil Procedure Code of Armenia. This includes instances of submitting a demand and copies of relevant documents to the involved parties, unless proof of using the mechanism of protection of the right to demand is provided. The purpose of these requirements is to ensure both parties have access to relevant information and can present evidence supporting their claims. The information entered into the judicial system is published on the datalex.am website to protect the rights of the parties involved.

When submitting a claim to the court, relevant information is entered into the judicial information system at datalex.am. This includes details of the applicant, respondent, subject of the claim, volume of the disputed legal transaction, date of submission, and court and judge information. This information is also entered when an applicant submits an application for the use of the mechanism of protection of the right to demand or a report on its use to the court. The purpose of publishing this information on datalex.am is to ensure transparency and allow the opposing party to respond accordingly.

In order to address the increased requirement, cautious attention and active discussion are urged. Proposals have been submitted to the Constitutional Court and the Supreme Court of Armenia, but no response has been received thus far. It is important to find a solution that aligns with current legislation and upholds the rights of all parties involved.
