The Armenian “Legal” Newspaper has reported that a draft of the “Regulations on the Transfer of Administrative Management and Constructions of Territories” has been released for public discussion. This draft outlines the criteria for determining compensation for the transfer of the right of way for service roads. Changes and amendments will be made to the existing law on “Automobile Transportation” to address remuneration for this transfer, as stated in Article 12 of Law HO-250-N of July 12, 2023. The options for remuneration include monetary compensation, offsetting, exchange of movable property, transportation means, and automotive spare parts.

Under the new provisions, the compensation for the transfer of the right of way in operating public transit networks can be determined through competition among the operators serving the relevant routes. This determination will be based on proposals from the competition committee and the approval of the authority responsible for the operation of the public transit network. However, the regulations do not provide specific guidelines for determining compensation for changes or optimization of routes for independently operating public transit vehicles on separate schedules.

The draft regulation also considers the transfer of the right of way in cases where objective reasons require changes in the operation of public transit vehicles, as specified in Article 12, Section 12 of the aforementioned law. In these situations, there is a proposal to increase compensation through a competitive process. Additionally, the regulation suggests establishing a mechanism for determining compensation for changes in public transit routes without the requirement of competition.

Any changes in the remuneration for the transfer of the right of way will need approval from the competition committee and the authority responsible for the operation of the public transit network. The regulations will also address the criteria for determining compensation when objective reasons are present.
