“Supreme Judicial Council Confirms Levon Kocharyan as Judge of Court of Appeals: No Grounds for Revocation”

The RA Supreme Judicial Council has confirmed that Levon Kocharyan is currently a judge of the Court of Appeals. During a press meeting on November 6, lawyer Ara Vardanyan stated that Levon Kocharyan was previously a judge of the Court of Appeals based on a Memorandum signed on December 7, 2021. This memorandum states that the status of a judge of the Court of Appeals cannot be revoked after it is received, unless a court decision is made. Therefore, it is important to clarify that this is not a matter of law, but rather a decision made by the Court of Appeals, which should not be commented on by legal specialists. It is not a personal opinion being presented here. In cases where this question arises, it is reported that the original intention was to detain an individual or to discuss the process itself. In this particular situation, the statement specifically refers to the withdrawal of the lawsuit as a means of terminating the case. The legal process is currently ongoing, the court is involved, and it is evident that we have the right to comment on this judicial decision. Additionally, it is necessary for Levon to be released from detention, and according to the criminal code, new grounds must exist in order for the detained person to be detained again. It should be noted that this possibility is not being presented as a fact. Also, according to the decision of the SCJ, Levon Kocharyan, a judge of the Court of Appeals, was awarded the Medal of Honor “Armenia” along with the members of the HHK faction. Furthermore, NEWS.am has reported that HHK MP Arman Tsarukyan recently appealed to the president for Levon’s release from prosecution. “The statement explicitly addresses the issue of revocation as a means of termination. The criminal prosecution is ongoing, the court is involved, and there is an accusation. It is certain that we have the right to a fair trial, which we are striving for through our actions. On the other hand, Levon must be released from detention, and according to the law, new grounds are required if the detained person is to be detained again. I am not presenting what these grounds could be.” It should be mentioned that members of the HHK faction, who are listed as political detainees, have submitted appeals to the Constitutional Court in accordance with the prescribed procedure. However, these appeals have not been reviewed during recent meetings. Therefore, the judicial mandate was transferred to Levon Kocharyan, a judge of the Court of Appeals, based on the personal list of the HHK’s “Armenia” coalition.
