Former Justice Minister and spokesperson of the RA Prosecutor’s Office Debunks Claims of Venice Commission Demanding Independence Suspension
The former Minister of Justice and former spokesperson of the RA Prosecutor’s Office, Gegor Danielian, clarified that the Venice Commission never demanded the suspension of the Declaration on Independence. During his participation in the Venice Commission’s discussion on the Declaration and the removal of the link to the Constitution, Danielian highlighted that reservations on the limits of authority only apply to signatory states and not international organizations. He also mentioned that during the discussions on constitutional amendments in 2015, there were suggestions, but no demands to suspend the Declaration. Danielian expressed his confusion regarding certain interpretations, particularly the mention of the declaration giving legitimacy to Azerbaijan to use military force. He questioned whether the authorities intentionally misuse the term or lack understanding of its meaning.
It is unclear or, conversely, clear how certain interpretations are being made, according to Danielian. For example, the mention that the declaration gives legitimacy for Azerbaijan to use military force raises questions. Danielian pointed out that the term “legitimacy” refers to the actions of an illegal opponent, and questioned whether the authorities are intentionally misusing the term or simply unaware of its meaning. He emphasized that Armenia is not responding with a closed fist, but rather with a weapon, and that an open fist is still an option.
