“Appellate Court Ruling Sets Guidelines on Sacramental Wine Containing Artificial Ingredients”

The appellate administrative court, case number VD/8860/05/20, made a decision on November 9, 2023, regarding the protection of Candidate’s Rights in the Elections of the Control Chamber of 2020 (dated September 8, 2020, No. 336-A). The court established several important considerations concerning the replacement of sacramental wine with artificial substances.

One of the key findings is that the product called “Pani” cannot contain any artificial ingredients. Additionally, if sacramental wine contains artificial substances, it must be clearly indicated on the packaging. The producer has an obligation to properly label the product to ensure consumers are informed about the presence of artificial ingredients.

The court also emphasized that the technical regulations of the Customs Union “On Safety of Wine and Sacramental Wine” should include specific requirements regarding labeling. Information about the presence of artificial ingredients should be highlighted using an inverse color from the rest of the label. This will help consumers easily identify wines that contain artificial substances.

Furthermore, it is important to follow the Technical Regulation of the Customs Union when reproducing and replicating the label of sacramental wine. If the wine contains artificial ingredients, it should be considered a product that includes sacramental wine and has been produced using the technology described in the Technical Regulation. It must also undergo mandatory examination.

It is worth noting that the Control Chamber has previously issued a recall on the product “Pani” produced by the company “Voske Ser”. When this product contains artificial ingredients and has not undergone the mandatory examination, it cannot be regarded as sacramental wine. The Control Chamber has imposed a fine of approximately 5,000,000 drams for non-compliance.
