“Legal System Changes Jeopardize Proper Functioning of Judiciary as Former Judge Raises Concerns over Genex Cult Leader’s Case”
Significant changes have occurred in the legal system, which can greatly impact the functioning of the judiciary. On November 21, former judge of the RA Cassation Court, Mr. Haykob Enokyan, spoke out in defense of Gregor Magritte Khachaturov, the cult-leader of Genex. Enokyan stated that no new documents related to Khachaturov’s case have been added since March 13, 2023, and the Appellate Court acknowledged this on September 20, highlighting a judicial error and consequently overturning the court order. Khachaturov has been under house arrest for two months following the court’s decision.
With regards to whether the defense team is considering approaching the European Court of Human Rights, Enokyan mentioned that their priority is to exhaust all available remedies before considering such a step. “The protests regarding Khachaturov’s actions, which we vehemently condemn, go against the principles outlined in European standards,” stated Mihran Poghosyan.
Poghosyan further added that the abuses in this case are evident and have already been acknowledged by the courts, particularly the First Instance Court, where violations have taken place. He recalled that he had previously submitted an application to the Armenian MI5, which has since expired, without any progress being made on Khachaturov’s case. According to the defense, “They want Khachaturov to remain under house arrest.” It is believed that this decision has been made at the highest level.
Let’s not forget – on February 21, a significant theft of property took place using the official position of the former head of the RA Armed Forces, specifically intended for acquiring essential protective shields and weapons. The court ruled to detain Khachaturov as a result. However, this decision was denied by Judge Tigran Davtyan of the Cassation Court, leading to Khachaturov’s release on the same day.
On February 24, the Prosecutor General’s Office of the Republic of Armenia made a special decision to dismiss Grigor Khachaturov, a judge in the Court of First Instance, in response to a petition filed by the office to bring him to justice in the appropriate manner.
Following the appeal court’s ruling on March 16, the decision to appoint Grigor Khachaturov as a defender was revoked.
