Government Plans to Introduce New Trial Variety in Constitution to Improve Judicial System
During yesterday’s discussion, it was reported that the executive branch of the government plans to introduce a new variety of trials in the Constitution, aimed at improving trial organization. Professor Artur Ghambaryan, a Doctor of Law and criminal law specialist, shared this information on his Facebook page.
Ghambaryan explained that the purpose of the proposed change is to ensure a fair and impartial trial, as guaranteed by the Constitution, along with the protection of the rights of the accused. If the project, which is based on the principles of presentations, is accepted, the judicial authority will have the power to review verdicts, rectify any errors in the criminal justice process, and release the accused from unjustified prosecution.
In his Facebook post, Ghambaryan highlighted the importance of this change in restoring public confidence in the judicial system, particularly in cases involving excessive use of force and police brutality, such as the recent incident with “Hresh”. He provided an example where the verdict could be reconsidered, and an accused individual like Davit Sargsyan could be released without charges in such circumstances.
The proposed change serves two main purposes. First, it aims to restore public confidence in the military justice system through public examination. Second, it seeks to protect the rights of individuals by implementing military trials. Ghambaryan emphasized that legal and objective reviews should be conducted from the beginning, rather than relying on fictitious investigations.
This change in the trial system is seen as crucial for lawyers who often encounter abuses under military jurisdiction. By instituting military trials, it will provide them with a more reliable and fair legal framework to work within.
