“Renowned Attorney Takes Armen Ashotyan’s Case to European Court of Human Rights Over Violation of Fair Trial Rights”

Today, an application has been submitted to the European Court of Human Rights on behalf of Armen Ashotyan, alleging the violation of his right to a fair trial. This information was shared by attorney Tigran Atanesyan on his Facebook page.

As part of the application, a request has been made to the ECHR for interim measures to prevent the Republic of Armenia from unlawfully arresting Armen Ashotyan. The basis for this application revolves around the blatant violation of the principle of the presumption of innocence and the alleged political persecution of Ashotyan, which has been acknowledged by two prominent European political parties, according to Atanesyan.

The application has been filed based on the principle of exhausting domestic remedies when an individual faces the risk of violence or persecution in their country. It should be noted that exceptions to this principle exist, and the right is not limited based on the nature of the case. An example of such an exception can be seen in the case of Aleksey Navalny, where the court demanded his release from unlawful arrest,” Atanesyan explained.

In the case of Armen Ashotyan, there are also grounds for making exceptions to the principle. Ashotyan is a political figure, known for his political activities and criticism, which are an integral part of his political beliefs,” he added.

While there may be limited expectations regarding the involvement of the ECHR, given the suspicion of double or triple standards, the hope is that justice will prevail and a fair decision will be reached,” Atanesyan expressed.
